Employer & Worker Responsibilities

Participation in Canada’s Temporary Foreign Worker Program (TFWP) requires shared responsibility. Both employers and workers must understand and comply with their legal obligations to ensure lawful, fair, and ethical employment.

Employer Responsibilities

Employers hiring through the Temporary Foreign Worker Program are required to comply with all applicable federal and provincial laws. Key responsibilities include:

  • Demonstrating a genuine labour need and recruiting Canadians where required
  • Applying for and receiving a positive Labour Market Impact Assessment (LMIA) when applicable
  • Paying all government processing fees related to the LMIA and employment process
  • Providing a written job offer and employment contract that accurately reflects duties, wages, and working conditions
  • Paying fair wages in accordance with employment standards
  • Ensuring a safe, healthy, and respectful workplace
  • Providing workers with information about their rights in Canada
  • Keeping employment records and documentation for government inspections
  • Failure to meet these obligations may result in penalties, loss of program access, or other enforcement actions by Canadian authorities.

Worker Responsibilities

Temporary foreign workers are also required to comply with Canadian laws and the conditions of their work permits. Worker responsibilities include:

  • Meeting the qualifications and requirements of the job offered
  • Holding valid identity documents and a lawful work permit
  • Working only for the employer and considered role authorized on the permit
  • Following Canadian laws, workplace policies, and safety requirements
  • Performing job duties honestly and professionally
  • Informing authorities or seeking support if rights are violated or conditions change

Workers should fully understand the terms of their employment before accepting any job offer.

Ethical and lawful employment under the TFWP depends on cooperation between employers and workers. Understanding responsibilities helps prevent misunderstandings, protects rights, and ensures compliance with Canadian labour standards.
