Temporary foreign workers have the right to:
- A written employment contract that clearly outlines job duties, wages, and working conditions
- Payment of fair wages as agreed, with lawful deductions only
- A safe and healthy workplace that meets Canadian safety standards
- Freedom from abuse, harassment, or unsafe demands
- The right to keep personal documents, including passports and work permits
- Freedom to change employers where legally permitted
- Protection from retaliation for reporting abuse or unsafe working conditions
Protection From Exploitation
Canadian law strictly prohibits exploitation of temporary foreign workers. Workers must not be:
- Charged recruitment, placement, or processing fees
- Forced to perform work outside agreed job duties
- Threatened with deportation without lawful basis
- Misled about job conditions, wages, or legal consequences
Any attempt to control, intimidate, or exploit a worker is unlawful.
Health & Safety Protections
Employers are required to:
- Provide a safe working environment
- Follow occupational health and safety laws
- Inform workers of workplace hazards and safety procedures
- Workers have the right to refuse unsafe work without fear of punishment.
Reporting Concerns
Workers who experience abuse, unsafe conditions, or violations of their rights are encouraged to seek help through appropriate legal or support channels. Reporting concerns does not automatically affect a worker’s immigration status.

Prohibited practices by TFWP employers (Canada):
- Charging workers recruitment, LMIA, or placement fees
- Paying less than the approved wage or making illegal deductions
- Providing unsafe, abusive, or exploitative working conditions
- Confiscating passports, work permits, or personal documents
- Threatening deportation or immigration consequences
- Forcing workers to do jobs outside the approved role or employer
- Failing to provide promised benefits or contract conditions
- Restricting workers’ freedom, movement, or communication
- Providing unsafe or illegal housing (when housing is required)
- Discriminating against temporary foreign workers
- Retaliating against workers who report abuse
- Providing false or misleading information to the government
Violations can lead to heavy fines, bans from the TFWP, and criminal penalties.
