📌 About the Temporary Foreign Worker Program (TFWP)
The TFWP allows Canadian employers to temporarily hire foreign nationals when qualified Canadian workers are not available. The program is governed by Canadian federal law and administered through:
- Employment and Social Development Canada (ESDC)
- Immigration, Refugees & Citizenship Canada (IRCC)
- Canada Border Services Agency (CBSA)
Employers must apply for a Labour Market Impact Assessment (LMIA) to demonstrate a genuine labour need. Once a positive LMIA is issued, the worker can apply for a Canadian work permit.

In Canada, temporary foreign workers have the same basic rights as Canadian workers. Rights include:

❌ Prohibited Practices
Canada’s laws strictly prohibit the following:
🚫 Charging workers recruitment or LMIA processing fees — including travel, legal, or administration costs — under the TFWP or related to hiring.
🚫 Deducting recruitment costs from wages or employment benefits
🚫 Withholding or taking a worker’s passport or official documents
🚫 Threatening deportation or retaliation without lawful basis
🚫 Misrepresenting jobs, wages, duties, or legal consequences
🚫 Abusive treatment, coercion, or control over worker movement or freedom of choice
Employers found violating these rules can face fines, LMIA revocation, bans from the program, and public disclosure.
